1. Scope
These Terms & Conditions apply to services offered by Thomas Triesschijn (Bernstrasse 10, 6003 Luzern, Switzerland) through this website, including concert engagements, chamber music performances, and the rental of historical keyboard instruments (harpsichords) for recordings, concerts, and special projects. Browsing the website itself is free and not subject to these terms beyond the Legal Notice and Privacy Policy.
2. Enquiries and Bookings
Enquiries made via email or the contact details on this website are non-binding. A booking, engagement, or rental only becomes binding once both parties have confirmed the specific terms — including dates, fee/rental price, and any special conditions — in writing (email is sufficient unless a formal contract is required).
3. Concert Engagements
Terms for individual performances (fee, travel and accommodation arrangements, programme, technical requirements, cancellation terms) are agreed separately for each engagement. In the absence of a specific written agreement to the contrary, customary professional standards for concert engagements apply.
4. Instrument Rental
The harpsichords available for rental are historical or historically informed instruments requiring careful handling. Rental is subject to a separate written rental agreement to be signed before the instrument is released, which will cover, at minimum:
- rental period and price;
- transport arrangements and who bears the associated risk and cost;
- a security deposit and/or insurance requirement covering loss or damage;
- conditions of use (climate control, handling, permitted repairs/tuning); and
- liability for damage during the rental period.
No instrument is released without such an agreement in place.
5. Payment
Payment terms (amount, due date, deposit if applicable) are set out in the individual booking confirmation or rental agreement. Unless otherwise agreed, invoices are payable within [30] days of the invoice date.
6. Cancellation
Cancellation terms are agreed individually as part of each booking or rental agreement. Where no specific cancellation clause has been agreed, both parties are expected to notify the other as early as reasonably possible, and reasonable costs already incurred may be charged.
7. Intellectual Property
Photographs, audio and video recordings, and other content on this website remain the property of Thomas Triesschijn or the credited rights holder. Recordings or filming of performances by third parties require prior written consent.
8. Liability
Thomas Triesschijn is liable in accordance with the applicable provisions of Swiss law. Liability for slight negligence is excluded to the extent permitted by law. This does not affect liability for intent or gross negligence, or for damage to life, body, or health.
9. Severability
If any provision of these Terms is or becomes invalid, this does not affect the validity of the remaining provisions.
10. Applicable Law and Jurisdiction
These Terms are governed by Swiss law, to the exclusion of its conflict-of-law rules. The place of jurisdiction, to the extent permitted by law, is Lucerne, Switzerland.
